Terms of Service

1. What Envite is and who provides it

Envite is a platform for creating, publishing and managing digital invitations and the information that goes with an event: RSVPs, guests, tables and a photo album. It is provided through the website getenvite.com. The service is provided by PENDIENTE, with its address at PENDIENTE. Its full details are in the Legal information. These terms govern the purchase and use of the service. By creating an account, buying a plan or using the platform, you accept them. If you do not agree, you must not use it.

2. How to purchase

1. You choose a plan (and, if you like, a template) and add it to the basket. You can change or remove anything before paying. 2. You enter your details and accept these terms. If you wish, you can also sign up for our offers and news by email; this is optional. 3. You pay on Stripe's payment page, where you see the exact total, including taxes, before confirming. Until then you can correct any mistake by going back. 4. Once the payment is confirmed, we create your account and your events, and we email you a confirmation with a summary of the purchase, these terms and how to cancel it. The contract may be concluded in Spanish or in English, and we record which one you accepted. If the two versions of these terms ever differ, the Spanish version prevails, unless the law requires the interpretation most favourable to you. We keep an exact copy of the version of these terms and of the Privacy Policy you accepted, together with the date and time and the IP address and browser you used. You can see what you accepted in your account, and every previous version is published in the legal documents history.

3. Who can purchase

You must be of legal age under the law of your place of residence (in Puerto Rico, 21) or have the consent of your mother, father or guardian, and in any case be at least 18 years old. Envite is not directed at children under 13. If you purchase on behalf of a company, you declare that you have the authority to bind it; in that case the rules that protect only consumers do not apply to you.

4. Your account

You are responsible for keeping your password confidential and for the activity carried out from your account. If you detect any unauthorised use, let us know immediately.

5. Plans, prices and taxes

Envite is purchased PER EVENT, with a one-off payment: there is no subscription and no automatic renewal. Each event has its own plan (Invita, Celebra or Experiencia). Prices are shown in the stated currency and exclude taxes. Puerto Rico's IVU sales tax (11.5%) or your state's tax, where applicable, is calculated from your billing address and added at checkout; you see the exact total before confirming the payment. There are no other charges. Payments are processed through Stripe; Envite never sees or stores your card details. The plan's features are activated when the payment provider confirms the charge. You can upgrade an event's plan at any time by paying only the difference between the price of the new plan and what you have already paid for that event. Downgrading to a lower plan is not possible.

6. Cancellation and refund

You can cancel a purchase within 14 days of making it, without giving any reason, and we will refund the full amount, taxes included, as long as you have not published that event's invitation. The service begins as soon as the payment is confirmed. When you publish an event's invitation, the service for that event has been provided and you can no longer cancel its purchase. How to cancel: · Online, from “Cancel my purchase here”, in the footer of every page. We will email you an acknowledgement of receipt with the date and time. · By writing to PENDIENTE. We will refund you within 14 days of receiving your request, using the same payment method you used and at no cost to you. The event of that purchase will no longer be available. Depending on your bank, the refund may take a few more days to appear in your account. If you live in the European Union, the European Economic Area or the United Kingdom, this policy is also your legal right of withdrawal; section 20 contains the information that applies to you.

7. Other refunds and guarantees

In addition, we will refund what you paid if a technical fault attributable to Envite prevents you from using the service you purchased and we do not fix it within a reasonable time. Nothing in these terms limits the rights you have as a consumer under the law of your place of residence. In Puerto Rico, those rights are protected by the Department of Consumer Affairs (DACO).

8. Your content

You keep all rights to the texts, photographs, music and other content you upload. You grant us only the technical licence needed to store it, adapt it to the platform's format and display it within the service, for as long as the service lasts. You undertake to hold the necessary rights to what you upload and not to upload content that is illegal, infringes third-party rights or is offensive.

9. Your guests’ data

When you enter your guests' data, you decide what data you ask for and why, and you are responsible for it. Envite processes it on your behalf, as a service provider, and undertakes to: · Process it only to provide you with the event's service and in accordance with your instructions, which are the ones you give by using the platform. It does not sell it or use it for anything else. · Keep it confidential and require confidentiality from anyone who accesses it. · Apply the security measures described in the Privacy Policy. · Use only the providers listed there; we will tell you about any change in advance so that you can object. · Help you respond to your guests' rights and notify you without delay of any security breach affecting them. · Delete it when the event's service ends, within the periods set out in the Privacy Policy, except for what the law requires us to keep. · Give you the information needed to show that we meet these obligations. In return, you undertake to have obtained the data lawfully, to tell your guests that you use Envite to manage the event and not to ask them for data you do not need. Health data: if you ask your guests about allergies, intolerances or other health data, ask only for what is needed to organise the event and do not use the answers for anything else. Envite shows each guest who will see their answer and why, and answering is always voluntary; some laws, such as Washington's health data law, also require their consent. If your guests are in the European Union, this section is also the data processing agreement under Article 28 of the GDPR.

10. How long we keep your event

An event's content — album photos, invitation images, the guest list and their RSVPs — is kept for 45 days FROM THE DATE THE EVENT ENDS. After that period we delete it. The period is counted from the day the event takes place, not from when you published the invitation: you can publish it as far in advance as you like without shortening anything. We will email you at least 7 days in advance so that you can download anything you want to keep. We never delete the content of an event that has taken place without having sent that notice first. Deletion is permanent. Your account and the record of your purchases are not affected.

11. Acceptable use

The following is not permitted: using the platform for illegal activities or to send unsolicited communications; attempting to access other users' data or restricted areas; carrying out penetration testing without prior written authorisation; automating mass requests; reverse engineering the software; reselling the service without prior agreement; or impersonating another person.

12. Illegal content and copyright

ILLEGAL CONTENT If you find content on Envite — in an invitation, an album or any other page — that you believe is illegal or offensive, write to us at PENDIENTE with the exact address (URL) and the reason. We will review every report diligently and tell you what we have decided. If we remove content, we will explain the reasons to the person who published it, who can reply and ask us to review the decision. COPYRIGHT (DMCA) We respond to notices that comply with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe that content published on Envite infringes your copyright, send our designated agent a written notice including: 1. Your physical or electronic signature, or that of the person acting on your behalf. 2. The copyrighted work you believe has been infringed. 3. The content you believe is infringing and its exact address (URL), with enough information to locate it. 4. Your name, address, telephone number and email address. 5. A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law. 6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorised to act on its behalf. Designated agent: PENDIENTE, PENDIENTE, PENDIENTE (subject: “DMCA”). If we remove your content following a notice of this kind and you believe it is a mistake, you can send us a counter-notification meeting the requirements of section 512(g) of that act; where appropriate, we will restore the content within the period set by law, unless the person who complained shows that they have filed a court action. In appropriate cases, we will close the accounts of repeat copyright infringers. A false notice may give rise to liability for damages. We handle requests in Spanish and in English.

13. Suspension and closure

We may remove content or suspend an account that breaches these terms or the law. Unless the seriousness of the case or the law prevents it, we will warn you first and tell you why, and you will be able to reply. You can stop using the service and ask us to delete your account whenever you like, from your profile or by writing to us. Amounts already paid are not refunded outside the cases in sections 6 and 7.

14. Availability and changes to the service

We work to keep the service continuously available, but we cannot guarantee 100% availability. We may carry out maintenance, giving advance notice whenever possible. The service may evolve: we may add, change or remove features, provided that we do not substantially reduce what you purchased for an event that has not yet taken place. If we ever shut the service down, we would give you enough notice to download your content and would refund what you paid for events that had not yet taken place.

15. Liability

We provide the service with due diligence. To the extent permitted by law, the service is provided “as is” and “as available”, without any warranties other than those set out in these terms. We are not liable for content published by users, for the accuracy of the data they enter about their events or for interruptions caused by third parties beyond our control (infrastructure providers, networks or payment gateways). To the extent permitted by law, we are also not liable for loss of profits or indirect damages, and our total liability for an event is limited to what you paid for it. Nothing in the above limits our liability for wilful misconduct or gross negligence, or the rights that the law grants to consumers and that cannot be excluded by contract.

16. Your liability towards third parties

If you use the service in breach of the law or these terms — for example, by uploading content you do not hold the rights to or guests' data obtained unlawfully — and this leads to a third-party claim against Envite, you will be liable for the damage caused to us, on the terms established by law.

17. Changes to these terms

We may update these terms. If the change is substantial, we will notify you by email or through a prominent notice on the platform at least 15 days in advance. Each purchase is governed by the version you accepted when you made it. New versions apply to later purchases and, for use of the platform, from their entry into force. When we publish a new version we will ask you to accept it expressly when you sign in to your account. Every previous version remains published, exactly as it was shown, in the legal documents history.

18. Governing law and complaints

These terms are governed by the laws of Puerto Rico and, where applicable, by the federal laws of the United States. If you have a complaint, write to us first at PENDIENTE: we will reply as soon as possible. If we do not resolve it, you can file a complaint with Puerto Rico's Department of Consumer Affairs (DACO, daco.pr.gov) or with your state's consumer protection agency, or go to the courts of Puerto Rico. There is no arbitration clause: nothing in these terms requires you to submit to arbitration. If you purchase as a consumer from another country, you keep the protection given to you by the mandatory laws of your country and you can go to the courts of your place of residence.

20. If you live in the EU, the EEA or the United Kingdom

If you purchase as a consumer from the European Union, the European Economic Area or the United Kingdom: · Right of withdrawal: you have 14 calendar days from the purchase to withdraw without giving any reason, through the same channels and with the same refund period as in section 6. · Point of contact for the purposes of Regulation (EU) 2022/2065 on Digital Services, for authorities and users: PENDIENTE. The procedure for reporting illegal content is the one in section 12.
